Civil Process

By Michigan statue the County Sheriff is required to execute civil process.  The following Public Acts define duties and fees allowed:

Public Act 173

Public Act 133

Process in civil actions may be served by any person of suitable age and discretion who is not a party nor an officer of a corporate party.  The sheriff or other Officer, serving any process or paper, shall be entitled to traveling fees for such service, from the county seat of the county in which service was made, to the place of service therein.

Presque Isle County Sheriff's Office does not provide any blank civil process forms.  These may be obtained from the District or Circuit court in the jurisdiction in which the case arose or from the attorney's office if the suit is being handled by an attorney.  Fees for service of civil process are as follows:

Summons & Complaint $23.00

Garnishment $20.00

Claim & Delivery $37.00

Order to show cause $23.00

Subpoena $23.00

Request/Order to Seize Property $37.00

Notice to Quit-Landlord/Tenant $35.00

Mortgage Sale $50.00

Notice of Mortgage Sale $21.00

PersonalProtection Order $18.00

Mortgage Sale Adjournment $8.00

Writ of Restitution $37.00

Mileage is .80 per mile.

Service fees are billed after service has been made or attempted.  We do not charge for attempts.
